End User License Agreement (EULA) — Montreal Casino Key Pass

Agreement to Terms

This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and MC Key Pass LTD for the Montreal Casino Key Pass software application ("the Software"), which includes the iOS application and any associated documentation.

Important

By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software.

License Grant

MC Key Pass LTD grants you a limited, non-exclusive, non-transferable, revocable licence to:

Use the Software

Install and use the Software on iOS devices you own or control, solely for accessing your Casino de Montréal digital membership pass.

Access the Service

Access and use the App's features and services in accordance with this EULA and any applicable membership terms.

Use Your Account

Sign in to your membership account (issued by casino administration) to access your personalised digital pass and member features.

License Restrictions

You may NOT:

Copy, modify, or create derivative works of the Software.

Reverse engineer, decompile, or disassemble the Software.

Remove, alter, or obscure any proprietary notices on the Software.

Use the Software for any commercial purpose without authorisation.

Share your account credentials or digital pass with others.

Use automated systems to access the service (bots, scrapers, etc.).

Interfere with or disrupt the Software or its servers.

Use the Software in any unlawful manner or for any unlawful purpose.

Attempt to replicate, screenshot, or reproduce the rotating QR pass to gain fraudulent entry.

IP

Intellectual Property

The Software is licensed, not sold. MC Key Pass LTD retains all right, title, and interest in and to the Software, including all intellectual property rights. This EULA does not grant you any rights to trademarks or service marks of MC Key Pass LTD.

We Own

All software code, algorithms, designs, graphics, text, branding, and other content in the application.

You Own

Your personal account data and any communications you submit through the App's support features.

User Data and Privacy

Your use of the Software is also governed by our Privacy Policy. We collect and process your data as described in that policy. By using the Software, you consent to such collection and processing.

Data we may collect includes:

Account information (name, email, membership credentials)
Membership data (tier, member ID, pass status)
Device and usage information for app functionality
Support communications and submitted content

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MC KEY PASS LTD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Software will be uninterrupted, error-free, or free of harmful components. Temporary unavailability may occur due to maintenance or circumstances beyond our control.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MC KEY PASS LTD BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE.

This includes, but is not limited to, damages for loss of profits, loss of data, business interruption, or any denial of entry to Casino de Montréal resulting from technical issues with the Software.

Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any term. Upon termination:

You must cease all use of the Software.
You must delete or destroy all copies of the Software on your devices.
Your account may be deactivated or deleted.

Updates and Modifications

MC Key Pass LTD may provide updates, patches, or modifications to the Software. These updates may be automatically downloaded and installed via the App Store. You acknowledge that the Software may require such updates to continue functioning properly. We reserve the right to modify this EULA at any time. Continued use of the Software after changes constitutes acceptance of the modified EULA.

Governing Law

This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which MC Key Pass LTD operates, without regard to its conflict of law provisions. Any disputes arising from this EULA shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association.
